At Next Knowledge Solutions (NKS), we take privacy very seriously. NKS is committed to protecting your personal information. For that reason, NKS created this Policy which explains what personal information we collect about you, the purposes for which it is used and how we safeguard that information. If you do not agree to the privacy practices described in the Policy, please do not use "www.kurious.com.au" or related sites (collectively, the “Site”).

What this Policy Applies to
The personal information covered by this Policy (“Personal Information”) includes, but is not limited to, personal information which is collected online at the Site and personal information which NKS receives from its clients pertaining to contractors, customers and related parties of the clients ((a) and (b) collectively referred to as "Users").
By accessing and using our Services, you consent to the terms of this Policy and agree to be bound by it and our Terms and Conditions.

Collection of Personal Information
NKS collects Personal Information such as names, addresses, telephone numbers, email addresses and birth-dates. For example, if you register for a course online, we will collect your e-mail address. If you use NKS software through one of our clients, you may be asked to input information into an individual profile. This profile may include your name, registrations, certifications, qualifications, employment information and/or other information. Users may also be asked to select a password. We also collect Users' names, companies, industries, postal addresses, email addresses and/or phone numbers when they register to receive certain information from us and/or our Site. Personal Information collected by NKS will be stored in Australia.
If you use our Tutorial Hub forums on the Site, you should be aware that any personal information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages.  We are not responsible for the personal information you choose to submit in these forums.
By using the Service, you consent to your personal information being collected, held and used in accordance with the purposes described in this Policy.

Use of Personal Information
NKS uses Personal Information to:
  • Confirm and fill orders for products and services;
  • Assist clients with learning and people management requirements, and collaboration sessions;
  • Perform professional services;
  • Administer accounts and provide support;
  • Maintain databases and subscription lists;
  • Process job applications;
  • Update databases;
  • Alert Users to product upgrades, special offers, updated information and other new or complimentary products and services;
  • Deliver services, such as newsletters, events, training and software requested by Users;
  • Create and publish content relevant to Users;
  • Provide Users with access to limited-entry areas of our Site as appropriate;
  • Otherwise conduct its business operations; and
  • Contact Users as necessary for the above purposes.

We will not use Personal Information for any other purpose incompatible with the purposes listed above, unless it is required or authorized by you, is in your own vital interest or is necessary to comply with a legal obligation. Your Personal Information may be shared with NKS business affiliates in a manner consistent with the Policy.  At any time, if you do not wish your Personal Information to be shared with any NKS business affiliates, please contact us at http://www.kurious.com.au/support.aspx. With respect to Personal Information provided by clients, NKS uses such Personal Information solely for the purposes of performing tasks on behalf of, and under the instruction of, our clients as their service provider.
It is your responsibility to keep your password/passcode to the Service safe. You should notify us as soon as possible if you become aware of any misuse of your password/passcode, and immediately change your password/passcode within the Service or via the “Forgotten Password/passcode” process.

Use of Personal Information by Third Parties
Personal Information may be shared with third party agents who provide products and/or services to NKS and it customers, such as web site hosting, information technology consulting, web site management, foreign language support, complementary products and services requested by Users, data analysis, audit, legal, administrative, back-up, security, marketing and promotion. NKS works to ensure that such third parties use the Personal Information only for the purposes for which we engage them (or our customers request of them)  and under similar privacy protection to what we maintain.
In the event there is a change in NKS’s corporate structure, including, without limitation, merger, consolidation, sale, liquidation or transfer of substantial assets, NKS may, in its sole and absolute discretion, transfer, sell or assign information collected, including, without limitation, aggregated information and Personal Information, to one or more affiliated or unaffiliated third parties, as part of such restructuring.  Any affected Users will be notified via our Site or email.  NKS may also retain and disclose Personal Information in order to: (1) comply with applicable laws; (2) respond to governmental inquiries or requests; (3) comply with valid legal processes; (4) protect the rights, privacy, safety or property of NKS, Site visitors, clients or the public; (5) enforce our Site terms of service; and (6) permit us to pursue available remedies or limit the damages that we may sustain.

Direct Marketing
By submitting information on the Site, Users may receive promotional email updates about products and services related to their requests.  If, at any time, you would like to discontinue receiving any such email updates, you may unsubscribe by following the unsubscribe instructions included in each promotional email.  

NKS can aggregate your non-personally identifiable data
By using the Service, You agree that NKS can access, aggregate and use non-personally identifiable data NKS has collected from you. This data will in no way identify you or any other individual.

NKS may use this aggregated non-personally identifiable data to:
  • Assist us to better understand how our customers are using the Service,
  • Provide our customers with further information regarding the uses and benefits of the Service, otherwise to improve the Service.

Third Party Promotions
NKS does not provide personal information to third parties for the purpose of Third Party Promotions.

NKS only discloses Your Personal Information in limited circumstances
NKS will only disclose the personal information you have provided to us to entities outside of NKS if it is necessary and appropriate to facilitate the purpose for which your personal information was collected pursuant to this Policy, including the provision of the Service.
NKS will not otherwise disclose your personal information to a third party unless you have provided your express consent. However, you should be aware that NKS may be required to disclose your personal information without your consent in order to comply with any court orders, subpoenas, or other legal process or investigation including by tax authorities, if such disclosure is required by law. Where possible and appropriate, we will notify you if we are required by law to disclose Your personal information.
The third parties who host our servers do not control, and are not permitted to access or use your personal information except for the limited purpose of storing the information. This means that, for the purposes of Australian privacy legislation and Australian users of the Service, NKS does not “disclose” personal information to third parties located overseas.

Use of 'Cookies" and other Tracking Technologies
In providing the Service, NKS uses "cookies". A cookie is a small file which is stored on your computer. A cookie does not identify you personally or contain any other information about you but it does identify your computer.
We use a combination of “persistent cookies” (cookies that remain on your hard drive for an extended period of time) and “session ID cookies” (cookies that expire when You close Your browser) on the Website to provide your user experience of the service.
NKS sends billing information, product information, Service updates and Service notifications to you via email notifications. Our email notifications will contain clear and obvious instructions describing how you can choose to be removed from any mailing list not essential to the Service. NKS will remove you at your request.
As is true of most web sites, we gather certain information automatically and store it in log files.  This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, or site functionality. 
We use Local Storage also referred to as HTML5 to store content information and preferences.

Data Storage
All Data, including personal and non-personal information, which is entered into the Service by you, or automatically imported on your instruction, is transferred to NKS’s servers as a function of transmission across the Internet. By using the Service, you consent to your personal information being transferred to our servers as set out in this Policy.
Our servers are located in Australia, provided by Microsoft Azure and GTC Networking and those servers form part of our Service. If the location of our servers change in the future, we will update this Policy. You should review our Policy regularly to keep informed of any updates.
By providing your personal information to NKS, you consent to NKS storing your personal information on servers hosted in Australia. While your personal information will be stored on servers located in Australia, it will remain within NKS’s effective control at all times. The server host’s role is limited to providing a hosting and storage service to NKS, and we have taken steps to ensure that our server hosts do not have access to, and use the necessary level of protection for, your personal information.
If you do not want your personal information to be transferred to a server located in the Australia, you should not provide NKS with your personal information or use the Service.

External Links
The Site may include links to other web sites not controlled by NKS. Please note that we are not responsible for the collection, use, maintenance, sharing, or disclosure of data and/or information by such third parties. Once you leave our Site, use of any information you provide is governed by the privacy policy of the operator of the site you are visiting. That policy may differ from ours. We encourage you to read the privacy policies of web sites that you visit before submitting personal information. If you can't find the privacy policy of any of these web sites via a link from the web site's homepage, you should contact the web site directly for more information.
The Service may allow you to transfer Data, including your personal information, electronically to and from third- party applications, for example, report exports. NKS has no control over, and takes no responsibility for, the privacy practices or content of these applications. You are responsible for checking the privacy policy of any such applications so that you can be informed of how they will handle personal information.

Security and Confidentiality
NKS takes appropriate and commercially reasonable technical and organizational measures to protect Personal Information against unauthorized access, accidental loss or damage and unauthorized destruction. NKS employees who handle confidential, proprietary or personal information are required to treat it confidentially and are not permitted to use it for purposes unrelated to NKS's business or disclose it to unauthorized third parties.
For online financial transactions, we do not perform any nor collect any related personal information that you transmit to us via our Site. Unfortunately, however, no security system or system of transmitting data over the Internet can be guaranteed to be entirely secure. NKS takes steps to protect your Personal Information
NKS is committed to protecting the security of your personal information and we take all reasonable precautions to protect it from unauthorised access, modification or disclosure. Your personal information is stored on secure servers.

We may update this Policy from time to time. When we do so, changes in our Policy will be effective immediately upon posting the revised Policy to the Site.
